I found this author’s Americans Against Abusive Probate Guardianship web site after reading Rachel Aviv’s terrifying New Yorker article “How the Elderly Lose Their Rights.” My lawyer friends have taught me not to draw any conclusions until I’ve read the applicable statutes which are always available though Cornell Law and state legislature web sites. I was shocked to learn that the law in Nevada, the state that Aviv reported on, allows a probate judge to break a living trust. Further web searching revealed that other states also allow a judge to nullify a person’s wishes for the distribution of belongings after death. Yikes! Everything Suze Orman said about money bringing security was wrong. The guardianship system punishes people for being responsible and staying out of debt. Money just makes a person a higher value target for a predatory guardian.I am impressed with Dr. Sugar’s cogent analysis of the guardianship system in this country. I plan to implement some of the suggestions in his book. In particular, I plan on making a video of me reading an advance directive forbidding that I ever be made the property of a professional guardian. I’m going to include instructions that the video be supplied to media outlets if my wishes are disregarded. I’m also going to write, notarize, and film a statement that my video is released from all copyright restrictions. I don’t want to have a guardian negate my wishes by suppressing my video by copyrighting my image. Perhaps it’s a quixotic Thermopylae-Alamo-Warsaw Ghetto strategy. I may die broke, isolated, and abused in a substandard nursing home. But at least I will have made one last stand against oppression.
